Kyran Lee, of Gainsborough, Lincolnshire, narrowly avoided jail, after appearing at Lincoln Crown Court this week.

25-year-old Lee set up a Facebook profile under the name ‘Joey G-Star Crislow’  and made contact with the victim – who cannot be named for legal reasons.

The pair began dating and were seeing each other for three weeks before the incident occurred.

The court heard: “The defendant wore a bodysuit and the lights were off. The offence took place three weeks after they met.

“The defendant gave the victim oral sex. Then with one hand on what she thought to be his penis, he penetrated her. He used a sex toy.”

The victim complained to police when she discovered Lee was working under his female birth name. She said: “I was weak and vulnerable. Finding out that Kyran Lee was a female shocked me to my core.”

Lee, who is awaiting gender surgery, admitted one charge of assault by penetration.

Judge Michael Heath conceded the case was “unusual”, and said: “The defendant sent pictures of a good-looking, muscular, young man, he sent toys to her children, said he loved her and understandably she wanted to meet him.” The judge added that the victim “only had that intimacy with him because she thought that he was a man.”

However, Judge Michael Heath added: “I accept the whole motivation – however selfish, dreadful and deceitful – was to have a relationship. Not a physical one, but a relationship with a woman as a man. The defendant did not enter subterfuge to gain sexual gratification or activity with a woman.” Due to the circumstances, Lee avoided a custodial sentence – and was instead handed a suspended two-year sentence.
